On 6/5/2021 at approximately 0234 hours, a Berwick Borough Police Officer was in a marked Berwick Police Vehicle in the 400 block of West 3^rd Street when the officer observed the vehicle behind him had an inoperable headlight.

The officer initiated a traffic stop with the vehicle and identified the driver as Wilfredo Cruz. The officer had seen signs of intoxication and felt that Cruz was under the influence to a degree which rendered him incapable of safely operating a motor vehicle. Cruz was taken into custody for suspicion of driving under the influence of alcohol.

Cruz was transported to the Berwick Police Station where he submitted to a chemical test of breath. Cruz had a BAC of 0.203.
